Data Privacy Statement for Website Visitors

In the following, we, SCHOMBURG GmbH & Co. KG, explain the processing of your private data in connection with your visit to our website. If you have any questions about data protection, please feel free to contact our data protection officer at thomas@werning.com.

Purpose, legal basis, categories of recipient, duration of storage for data processing
Purpose: Presentation of the company, provision of services and/or sale of products and communication via the internet.

The purpose of the data processing on this website is to provide information about the products and services of our company with the associated possibility for the user to purposefully communicate with our contact persons.

We process personal data in accordance with the following legal bases:
• Art. 6, para. 1 lit. a of the German Data Protection Regulation [DSGVO ] for the processing of personal data with consent of the affected person.
• Art. 6, para. 1 lit. b of the German Data Protection Regulation for fulfilment of a contract with the affected person and implementation of associated pre-contractual measures.
• Art. 6, para. 1 lit. c of the German Data Protection Regulation for the necessary processing of personal data for fulfilment of a legal obligation to which we are subject according to applicable EU law or according to the law of the country in which the German Data Protection Regulation partly or wholly applicable.
• Art. 6, para. 1 ref. f of the German Data Protection Regulation for the necessary processing of personal data in order to protect our entitled interests or those of third parties, insofar as they do not outweigh the basic liberties and basic rights and interests of the affected person. Entitled interests are, in particular, our commercial interest in being able to provide our website, information security, assertion of legal claims and observance of other legal requirements.

For this purpose, we commission service-providers obligated to secrecy and data protection in the scope of the provision of services. Transfer to public authorities takes place exclusively in case of overriding legal requirements.

A connection to your browser is established when you visit the website. This following information that is collected is stored as temporary system files and recorded automatically: IP address of your device, date and time of the visit, name and URL of the files viewed, website from which the visit took place and/or from which you were led to our page (referrer URL), browser and, if applicable, the operating system of your device and name of your provider.

We process the indicated data for the purpose of establishing a smooth connection and for system security. The accumulating connection data is deleted automatically – normally after a maximum of seven days. Insofar as the website is misused, log data required for evidence will be stored until the case has been resolved.

Handling of personal data
The website operator collects and uses your personal data, and only transfers it to a third party when permissible within the legal scope or you have given your consent to the data collection. All information used to determine identify you and which can be used to track you – i.e. your name, email address and telephone number – applies as personal data.

Handling of contact data
Should you contact the website operator by means of the available contact options, your information is stored so that it can be accessed for processing and replying to your enquiry. This data is not transferred to third parties without your consent.

Google Analytics
This website uses Google Analytics, a web analysis service of Google Inc. ("Google"). Use takes place based on Art. 6, para. 1, p. 1 lit. f of the German Data Protection Regulation. Google Analytics uses "Cookies", which are text files that are stored on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of the website, such as
- browser type/version,
- operating system,
- referrer URL (the previously visited page),
- host name of the visiting computer (IP address),
- time of the server enquiry,
are normally transmitted to a Google server in the USA and stored there. The IP address of your browser determined in the scope of Google Analytics is not combined with other data of Google. We have also extended the Google Analytics on this website with the "anonymizeIP" code. This guarantees the masking of your IP address so that all data is collected anonymously. The full IP address is only transmitted to a Google server in the USA and abbreviated there in exceptional cases.

Google uses this information on behalf of the operator of this website in order to evaluate your use of the website in order to compile reports about the website activities and in order to provide the website operator additional services associated with the website use and internet use. You can prevent the storage of cookies with an appropriate setting in your browser software. However, bear in mind that you may not be able to use all functions of this website to the full extent in this case.

You can also prevent the collection of the data generated by the cookie and related to your use of the website (incl. your IP address) on Google and the processing of said data by Google by downloading and installing the browser plug-in available via the following link: http://tools.google.com/dlpage/gaoptout?hl=de. As an alternative to the browser add-on, particularly for browsers on mobile end devices, you can also prevent the collection by Google Analytics by clicking on this link. An opt-out cookie which prevents future collection of your data when visiting this website is set. Information about the newsletter and consent
We have provided the following information to explain the content of our newsletter and the registration, delivery and statistical evaluation processes, as well as your cancellation rights. By subscribing to our newsletter, you express your consent to the receipt and the described processes.

Content of the newsletter
We send newsletters, emails and other electronic notifications with commercial information (hereinafter "Newsletter") only with the consent of the recipient or statutory permission. Insofar as the content of the newsletter is paraphrased in the scope of a registration to the newsletter, it is relevant for the consent of the user. Our newsletters contain information about products, product documents, trade fairs / events, references and general marketing activities and company information.

Double opt-in and logging
The registration for our newsletter takes place in a double opt-in process. In other words, after registration, you receive an email in which you are requested to confirm your registration. This confirmation is necessary so that no one with a third-party email address can register.
Registrations for the newsletter are logged in order to be able to verify the registration process according to legal requirements. This includes storage of the time of registration and confirmation and the IP address. Changes to your data stored by MailChimp are also logged.

Use of the "MailChimp" delivery service provider
Delivery of the newsletter takes place with "MailChimp", a newsletter delivery platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA, 30308, USA. The email addresses of our newsletter recipients, as well as their other data described here, are stored on the servers of MailChimp in the USA. MailChimp uses this information for delivery and for evaluation of the newsletter on our behalf. Furthermore, MailChimp can use this data for optimisation or improvement of their own services according to their own information, e.g. for technical optimisation of the delivery and representation of the newsletter or for economic purposes in order to determine the countries from which the recipients come. However, MailChimp does not use the data of our newsletter recipients to contact them or to transfer said data to third parties.
We trust the reliability and the IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement „Privacy Shield“ and obligated to compliance with the EU data protection requirements. We have also concluded a „Data-Processing-Agreement“ with MailChimp. This is a contract in which MailChimp commits to protect the data of our users, to process said data on our behalf according to our data protection provisions and to refrain from transferring said data to third parties. Registration data
You only have to specify your email address to register for the newsletter.
We ask you to optionally specify your first and last name and your company. This information is only provided for personalisation of the newsletter.

Statistical collection and analysis
The newsletter contains a "web-beacon", i.e. a pixel-size file which is called up by the MailChimp server when the newsletter is opened. Technical information, such as information about the browser and your system and your IP address and time of the call-up are collected in the scope of this call-up. This information is used for technical improvement of the service based on the technical data or the target groups and their reading behaviour based on call-up locations (which can be determined based on the IP address) or the access times.
Specification of whether the newsletters are opened, when they are opened and which links are clicked are also included in the statistical collection. For technical reasons, this information can be assigned to the individual newsletter recipients. However, neither we nor MailChimp have the ambition of monitoring individual users. Moreover, the evaluations help us to identify reading habits of our users and to adapt our content to them or send different content according to the interests of our users.

Online call-up and data management
There are cases in which we lead newsletter recipients to the websites of MailChimp. For example, our newsletters include a link with which the newsletter recipients can view the newsletter online (e.g. in case of display problems in the email program). Furthermore, newsletter recipients can correct their data, such as the email address. The Privacy Policy of MailChimp can also be viewed on their website.
In the connect, please bear in mind that cookies are used on the MailChimp website and that personal data is processed by MailChimp, their partners and service providers (e.g. Google Analytics). We have no influence on this data collection. For further information, refer to the Privacy Policy of MailChimp. Please also bear in mind the possibilities of objecting to data collection for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).

Termination/Cancellation
You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. In doing so, you also revoke your consent to its delivery via MailChimp and the statistical analyses. A separate revocation of delivery via MailChimp of the statistical evaluation is not possible.
A link for cancellation of the newsletter is provided at the end of each newsletter.

Legal principles of the German Data Protection Regulation
According to the requirements of the German Data Protection regulation, effective on 25 May 2018, it is our duty to inform you that consent to the delivery to the email addresses takes place on the basis of Art. 6 para. 1 lit. a, 7 of the German Data Protection Regulation and § 7 para. 2, no. 3, and para. 3 of the German Law Against Unfair Competition [UWG]. The use of the delivery service provider MailChimp, collection and analysis of data for statistical purposes and logging of the registration process take place on the basis of our entitled interests in accordance with Art. 6 para. 1 lit. f of the German Data Protection Regulation. Our interests are concentrated on the use of a user-friendly and secure newsletter system which serves our commercial interests and meets the expectations of users.

Please also bear in mind that you can object to future processing of your personal data at any time in accordance with the legal specifications as per Art. 21 of the German Data Protection Regulation. Your objection can take place, in particular, against processing of your data for the purpose of direct advertising.

Google Maps & YouTube
We use Google Maps to embed maps and YouTube to embed videos (legal basis in accordance with the German Data Protection Regulation: Art. 6, para. 1 lit. f with deactivation of the tracking functions in the YouTube code in the operation of our website and in consideration of the interests of affected parties). Google LLC in the USA has undertaken to guarantee appropriate data protection according to the American-European Privacy Shield. For further information, refer to the privacy policy of Google.

Your right to information, reporting, deletion, objection and data portability
You can assert your right to information, reporting and deletion of data at any time. Simply contact us via the aforementioned channels. Should you desire deletion of data, but we are still legally obligated to retain said data, the access to your data will be limited (blocked). The same applies in case of an objection. Your right to data portability can be asserted insofar as both we and the recipient have the technical capabilities available.

Right to legal remedy
You have the option of filing a complaint with the data protection authorities.

Data security / encryption
This website uses "Hypertext Transfer Protocol Secure (https). The connection between your browser and our server is encrypted.

Topicality and amendment of this data privacy statement
